Swiss Supreme Court says: Violence against visually impaired people is okay – helpless victim of violence convicted!
On 6 November 2020, Dr. Barbara Müller was traveling by train from Bern toward Spiez. As always, she was clearly recognizable as visually impaired by her white cane. Having barely survived a pulmonary embolism, she was medically prohibited (prescribed by her doctor) from wearing a mask. This was confirmed by a corresponding medical certificate.
Two overzealous “transport police officers” didn’t care about that. In a threatening tone, they ordered Dr. Barbara Müller to leave the train in Thun. How was a visually impaired woman supposed to find her way around in an unfamiliar station? How was she supposed to continue her journey? It was impossible for her to comply with this order immediately.
Instead of letting Dr. Barbara Müller continue her trip to her destination (only 10 minutes away), the enraged corona enforcers resorted to physical force. The transport police grabbed her and dragged their victim out of the train. To avoid falling, the visually impaired woman reflexively tried to hold on to a seat, but did not actively resist.
Now the federal judges Giuseppe Muschietti (FDP), Rolf von Felten (Mitte), and Patrick Guidon (SVP) declare in their legally outrageous reasoning that the victim is the perpetrator. The judges construct “obstruction of an official act” out of an elderly, visually impaired woman’s attempt to hold on.
The three federal judges sentence the visually impaired and disabled pensioner to pay CHF 6'020, plus an advance court fee of CHF 3'000 to the Swiss Supreme Court, as well as attorneys’ fees of CHF 18’629.25 – a total of CHF 27'649.25!
Rule of law in 2025. Is this justice?
In contrast, the behavior of the transport police is judged as legally justified, and the SBB gets off scot-free.
For Dr. Barbara Müller, this judicial arbitrariness has very real, dramatic consequences. She is in no way able to pay these CHF 27'649.25 from her own funds. The disabled pensioner now faces drastic consequences: loss of job due to a criminal record, debt enforcement, personal bankruptcy.
